Rules for using TrustPoint safely and responsibly

By using TrustPoint, you agree to these Terms & Conditions. If you do not agree, please do not use our platform.

Introduction

Welcome to TrustPoint, Ghana's trusted online marketplace for connecting verified importers and sellers with buyers.

These Terms & Conditions govern your use of TrustPoint's platform, including our website, mobile applications, and all services we provide. By accessing or using TrustPoint, you agree to be bound by these Terms.

These Terms apply to:

  • Buyers browsing and purchasing items
  • Sellers posting listings and selling products
  • Visitors accessing our platform
  • Users of TrustPoint Pay (our secure payment service)

TrustPoint is operated by TrustPoint Ghana Ltd, a company registered in Ghana.

Eligibility

To use TrustPoint, you must meet the following requirements:

Age Requirement

You must be at least 18 years old to create an account and use TrustPoint. By registering, you confirm that you meet this age requirement.

Accurate Information

You must provide accurate, complete, and up-to-date information during registration. Providing false information may result in account suspension or termination.

One Account Per User

Each person may create only one TrustPoint account unless explicitly permitted by us. Multiple accounts created to circumvent bans, fees, or other restrictions are prohibited.

Legal Capacity

You must have the legal capacity to enter into binding contracts. If you are using TrustPoint on behalf of a business, you represent that you have the authority to bind that business to these Terms.

User Accounts

Your Responsibility

When you create a TrustPoint account, you are responsible for:

  • Maintaining the security and confidentiality of your password
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach
  • Keeping your contact information current

Critical Security Rule

NEVER share your password, Mobile Money PIN, or OTP (One-Time Password) with anyone.

TrustPoint staff will NEVER ask for these credentials. Anyone requesting them is a scammer.

Account Suspension or Termination

TrustPoint reserves the right to suspend or terminate your account at any time if you:

  • Violate these Terms & Conditions
  • Engage in fraudulent or illegal activity
  • Provide false or misleading information
  • Harass or abuse other users or TrustPoint staff
  • Create multiple accounts to evade restrictions
  • Fail to resolve payment disputes or outstanding debts

Marketplace Rules

TrustPoint is a Platform

TrustPoint provides a marketplace platform that connects buyers and sellers. We are NOT the seller of items listed on our platform. Transactions are between buyers and sellers directly.

User Responsibility

Users are solely responsible for:

  • The accuracy of their listings
  • The quality and condition of items sold
  • Honoring commitments made in transactions
  • Complying with all applicable laws and regulations
  • Delivery, shipping, and customer service

Prohibited Items

The following items are strictly prohibited on TrustPoint:

  • Weapons and ammunition
  • Drugs and controlled substances
  • Counterfeit or pirated goods
  • Stolen items
  • Adult content or services
  • Live animals
  • Hazardous materials
  • Illegal goods or services

TrustPoint's Right to Remove Listings

TrustPoint reserves the right to remove any listing that:

  • Violates these Terms
  • Contains prohibited items
  • Is fraudulent, misleading, or inaccurate
  • Infringes on intellectual property rights
  • Receives multiple user reports
  • Poses a safety risk to users

Buying on TrustPoint

Buyer Responsibilities

As a buyer, you agree to:

  • Review listings carefully before making a purchase
  • Communicate respectfully with sellers
  • Pay for items promptly as agreed
  • Inspect items upon delivery and report issues immediately
  • Confirm receipt through TrustPoint Pay when satisfied

Review Before You Buy

Always check:

  • Seller verification badge
  • Item photos and description
  • Price reasonableness
  • Seller ratings and reviews
  • Delivery or meetup details

Communication Through TrustPoint

We encourage you to communicate with sellers through TrustPoint's messaging system or the provided WhatsApp contact. This creates a record that can help resolve disputes if needed.

Reporting Suspicious Listings

If you encounter suspicious listings, scams, or fraudulent behavior, report them immediately using the "Report Listing" button. Help keep TrustPoint safe for everyone.

Selling on TrustPoint

Seller Responsibilities

As a seller, you agree to:

  • Post accurate and honest descriptions of your items
  • Use clear, real photos of the actual item (not stock images)
  • Set fair and reasonable prices
  • Respond to buyer inquiries promptly and professionally
  • Honor all commitments made to buyers
  • Deliver items as described and within agreed timeframes

Accuracy of Listings

You must ensure that all information in your listings is accurate, including:

  • Item condition (new, used, refurbished)
  • Brand, model, and specifications
  • Defects, damage, or missing parts
  • Availability and location
  • Delivery or meetup options

Delivery Obligations

If you agree to deliver or ship an item, you must:

  • Package items securely to prevent damage
  • Ship within the agreed timeframe
  • Provide tracking information when available
  • Communicate any delays immediately

Consequences of Fraud

Misleading listings, counterfeit goods, or fraudulent behavior will result in:

  • Immediate removal of all listings
  • Account suspension or permanent ban
  • Withholding of pending payments
  • Reporting to law enforcement if applicable

TrustPoint Pay (Secure Payments / Escrow)

What is TrustPoint Pay?

TrustPoint Pay is our secure payment escrow service that protects both buyers and sellers during transactions. We hold the buyer's payment securely until the transaction is completed successfully.

How TrustPoint Pay Works

  1. Buyer pays through TrustPoint (Mobile Money or card)
  2. TrustPoint holds the payment securely (escrow)
  3. Seller ships or delivers the item
  4. Buyer receives and inspects the item
  5. Buyer confirms satisfaction or reports an issue
  6. TrustPoint releases payment to seller (or handles dispute)

Payment Hold & Auto-Release

When you pay through TrustPoint Pay, your payment is held securely until:

  • You confirm receipt and satisfaction with the item, OR
  • The auto-release period expires (typically 7 days after delivery confirmation)

Auto-release ensures that sellers receive payment even if buyers forget to confirm receipt. If you have an issue with your order, you must report it before the auto-release period ends.

Service Fees

TrustPoint charges a small service fee for using TrustPoint Pay. Fees are:

  • Clearly displayed before you complete a transaction
  • Deducted from the transaction amount
  • Used to maintain and improve our secure payment system
  • Subject to change with notice

Critical Security Notice

  • TrustPoint will NEVER ask for your Mobile Money PIN or OTP.
  • Anyone claiming to be TrustPoint staff and requesting these is a scammer.
  • Never share these codes with sellers, buyers, or anyone else.

TrustPoint is Not a Bank

TrustPoint Pay is a payment facilitation service, not a banking service. We partner with licensed payment processors to handle transactions. We do not provide banking, lending, or credit services.

Disputes & Reporting

Reporting Issues

If you experience a problem with a transaction, you can report it through:

  • The "Report an Issue" button in your TrustPoint Pay transaction
  • The "Report Listing" feature on any listing page
  • Contacting our support team directly

TrustPoint's Role in Disputes

When you report a dispute, TrustPoint will:

  • Review the evidence provided by both parties
  • Examine communication records, photos, and transaction details
  • Make a fair decision based on available evidence
  • Take appropriate action (refund, partial refund, release to seller, etc.)

Important Limitations

  • TrustPoint's decision on disputes is final for platform actions
  • We review disputes fairly but cannot guarantee a specific outcome
  • Refunds are not guaranteed in all cases
  • You may seek legal remedies through Ghana's courts if needed

Response Time

We aim to review and respond to disputes within 5-7 business days. Complex cases may take longer. We appreciate your patience.

Fees & Charges

TrustPoint may charge fees for certain services to maintain and improve our platform.

Service Fees

  • Transaction fees for using TrustPoint Pay
  • Listing fees for featured or promoted listings (if applicable)
  • Seller commissions on successful sales
  • Payment processing fees

Fee Transparency

All fees are:

  • Clearly displayed before you complete a transaction or action
  • Automatically deducted from transaction amounts
  • Non-refundable unless otherwise stated

Changes to Fees

TrustPoint may change fees at any time. We will provide reasonable notice of fee changes through email or platform notifications. Continued use of TrustPoint after fee changes constitutes acceptance.

Seller Payouts

For sellers using TrustPoint Pay, fees are deducted before payment is released to you. The amount you receive is the transaction amount minus applicable fees.

User Conduct

To maintain a safe and trustworthy marketplace, all users must follow these conduct rules.

Prohibited Behavior

You may NOT:

  • Engage in fraud, scams, or deceptive practices
  • Harass, threaten, or abuse other users or TrustPoint staff
  • Post spam, duplicate listings, or irrelevant content
  • List prohibited or illegal items
  • Manipulate reviews, ratings, or search rankings
  • Attempt to bypass TrustPoint's payment system to avoid fees
  • Use automated tools, bots, or scripts to access TrustPoint
  • Violate any local, national, or international laws
  • Infringe on intellectual property rights

Consequences of Violations

Violating these conduct rules may result in:

  • Warning notifications
  • Temporary account suspension
  • Permanent account ban
  • Removal of listings
  • Withholding of payments
  • Legal action or reporting to authorities

Intellectual Property

TrustPoint's Intellectual Property

TrustPoint owns all rights to:

  • The TrustPoint name, logo, and branding
  • Website design, layout, and graphics
  • Software, code, and algorithms
  • Content created by TrustPoint (help articles, policies, etc.)

You may not copy, reproduce, distribute, or create derivative works from TrustPoint's intellectual property without written permission.

Your Content License to TrustPoint

When you post listings, photos, or other content on TrustPoint, you grant us a non-exclusive, worldwide, royalty-free license to:

  • Display your content on TrustPoint
  • Store and process your content on our servers
  • Use your content for marketing and promotional purposes
  • Make your content searchable by other users

You retain ownership of your content. This license ends when you delete your content or close your account (though cached copies may remain temporarily).

Respecting Others' Rights

You must not post content that infringes on others' intellectual property rights, including copyrights, trademarks, or patents. Counterfeit items are strictly prohibited.

Privacy

Your privacy is important to us. How we collect, use, and protect your personal information is described in detail in our Privacy Policy.

By using TrustPoint, you agree to the collection and use of information as described in our Privacy Policy. These Terms & Conditions govern your use of the platform, while the Privacy Policy governs data handling.

Limitation of Liability

"As Is" Service

TrustPoint provides the platform "as is" without warranties of any kind, express or implied. We do not guarantee that:

  • The platform will be uninterrupted or error-free
  • All listings are accurate or that items will be delivered
  • Users will honor their commitments
  • The platform is free from viruses or harmful components

User Responsibility

TrustPoint is not responsible for:

  • The actions, conduct, or content of users
  • The quality, safety, legality, or accuracy of listings
  • Failed transactions, non-delivery, or disputes between users
  • Financial losses from using the platform
  • Decisions made by buyers or sellers

Limitation of Damages

To the maximum extent permitted by law, TrustPoint's liability for any claims arising from your use of the platform is limited to the fees you paid to TrustPoint in the 12 months before the claim arose.

TrustPoint is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

Force Majeure

TrustPoint is not liable for failures or delays caused by circumstances beyond our reasonable control, including natural disasters, war, strikes, internet outages, or government actions.

Termination

Your Right to Stop Using TrustPoint

You may stop using TrustPoint at any time. To delete your account, go to Profile → Account Settings → Delete Account. Note that:

  • Account deletion is permanent
  • Active transactions must be completed first
  • Some data may be retained for legal compliance
  • Outstanding fees must be paid before deletion

TrustPoint's Right to Terminate

TrustPoint may suspend or terminate your account at any time, with or without notice, if you:

  • Violate these Terms & Conditions
  • Engage in illegal or fraudulent activity
  • Pose a security risk to other users
  • Abuse or misuse the platform
  • Fail to pay fees or resolve disputes

Effect of Termination

Upon termination:

  • Your access to TrustPoint is immediately revoked
  • All listings are removed
  • Pending payments may be withheld pending investigation
  • You remain liable for any obligations incurred before termination

Changes to Terms

TrustPoint may update these Terms & Conditions from time to time to reflect changes in our services, business practices, or legal requirements.

How We Notify You

When we make significant changes, we will notify you by:

  • Email to your registered email address
  • A prominent notice on the TrustPoint platform
  • Updating the "Last Updated" date at the top of this page

Your Acceptance

Your continued use of TrustPoint after changes are posted constitutes your acceptance of the updated Terms. If you do not agree with the changes, you should stop using TrustPoint and close your account.

We encourage you to review these Terms periodically to stay informed.

Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of Ghana.

Any disputes arising from these Terms or your use of TrustPoint shall be subject to the exclusive jurisdiction of the courts of Ghana.

If any provision of these Terms is found to be invalid or unenforceable by a court, the remaining provisions shall remain in full force and effect.
